Zinwa loses legal battle over arbitration ruling

The Zimbabwe National Water Authority has suffered a legal setback after the High Court dismissed its application to overturn an arbitration ruling.

 The dispute arose from a contract dispute with Pellavin Marketing, a company that provided branding services to Zinwa. When a payment disagreement ensued, the matter was referred to arbitration.

 Arbitrator Tecla Mapota ruled in favor of Pellavin Marketing, finding that Zinwa had waived its right to challenge the arbitration process. Zinwa, dissatisfied with the ruling, appealed to the High Court, arguing that Mapota lacked jurisdiction to hear the case.

 However, High Court Judge Justice Faith Mushure dismissed Zinwa's appeal, upholding Mapota's decision. The court found that Zinwa had implicitly accepted the arbitration clause by engaging in the contractual relationship with Pellavin Marketing.
