Kombi Driver Jailed Two Years After Passenger Falls to Death While Hanging on Moving Vehicle

 

A Harare kombi driver has been sentenced to an effective two years in prison after a passenger he allowed to hang onto the rear of his moving vehicle fell off and later died from injuries sustained in the incident.

Nyasha Muteweye (33) was convicted of culpable homicide by Mbare magistrate Tinashe Ndokera, who also cancelled his driver’s licence and barred him from driving Class 2 vehicles.

The court heard that on February 5, 2026, around midnight, Muteweye was driving a commuter omnibus along Simon Mazorodze Road towards Waterfalls when he allowed passenger Bernard Taurai Genti to hang onto the back of the moving vehicle.

While negotiating a curve near the Chinzou roundabout at speed, the vehicle swerved, causing Genti to lose his grip and fall onto the road.

Genti sustained serious injuries and was taken to Sally Mugabe Hospital, where he died five days later.

Prosecutor Vimbai Makamure told the court that Muteweye acted negligently by allowing unsafe passenger conduct, failing to maintain proper control of the vehicle, and driving at excessive speed.

The court ruled that the driver’s actions directly contributed to the fatal incident, resulting in the custodial sentence.
