Vengesayi challenged to substantiate US$30m lawsuit against Tourism ministry

The court has placed burden of proof on House of Vengesayi (Pvt) Ltd to substantiate their US$30 million bill for architectural services in rendered in 2013 in the firm’s lawsuit against the Tourism ministry.

High Court judge Justice Rodgers Manyangadze this week directed Vengesayi to provide evidence to prove exactly what their bill entails:

“The cost runs into millions of United States dollars. There is certainly need for evidence to substantiate the claims.”

Vengesayi filed its application to force Tourism ministry to pay in 2016.

The Tourism ministry responded with an application for dismissal of the lawsuit saying that the application filed was for a different subject matter altogether.

Justice Manyangadze then ruled that the case should be heard because the ministry cannot just run away from its obligation as there was no dispute to the facts that services were rendered and nothing was paid:

“The plaintiff’s submissions are in sync with the applicable law. The defendant has not made submissions to the contrary. In light of this, the plaintiff’s prayer that the defendant’s defective plea be struck out must be granted.”

The onus is now on Vengesayi, through their legal representative, Advocate Tawanda Zhuwarara, to prove the substance of their US$30 million bill.
