The Harare Magistrates’ Courts today sat to hear the grounds on which the accused E-creator directors are seeking the right to be granted bail in a matter in which they allegedly swindled hundreds of people of their money thought a ponzi scheme.
Trymore Tapfumaneyi and Justin Muchekenya are being jointly charged with Chinese national Zhao Jiaotong for establishing and operating the scheme that scammed subscribers of a total amount believed to be US$1 million.
The magistrate, Marehwanazvo Gofa, is expected to make a ruling on Thursday afternoon, after both the state and defence have filed supplementary submissions.
The investigations officer from the Commercial Crimes Northern Region, Brighton Samaneka (IO), was today cross-examined by the State, represented by Pardon Dziva, and following were his responses to the questions posed.
State: Are you aware that the two accused persons are people of straw with no financial capacity?
IO: I wouldn't know their means at this stage.
State: They don't have any assets of value or any property.
IO: Then that becomes very dangerous because they can run away and have nothing to protect.
State: But they can't sustain any life in a new country because they are poor.
IO: You don't need to be rich to run away. You just need bus fare
State: If they have stringent conditions that they report three times a day, would that not allay fears of abscondment?
IO: That condition may be considered after six months after we are sure that we have gotten everything we want in terms of evidence. As we speak, our evidence is at risk of being interefered with
State: The two accused persons are not electronic gurus and would not do anything to jeopardise your investigations.
IO: I don't know their technical ability.
State: Can you confirm the stage at which the investigations are?
IO: The investigations began in earnest two weeks ago.
