It is the state’s case, as presented by prosecutor Nixon Chamisa, that on May 28, 2023 the 16-year-old complainant, name withheld, went to accused person’s place of residence around 5pm with the intention to collect his fifty cents that he was owed.
When he arrived, he knocked and the accused opened the door, grabbed his hand and dragged him into his bedroom where he asked him to be intimate with him, but the former refused.
The accused then forcibly removed the complainant’s trousers and threatened him with a knife if he cried for help.
He then proceeded to sodomize him four times without his consent.
The following day at around 0200hours the accused ordered the complainant to leave his bedroom, threatening to kill him with a knife if he told his parents about the incident.
The complainant then made a report to his parents, who reported to the village head and the matter was referred to Gutu police leading to the accused’s arrest.
