A man from Hatfield, Harare, who allegedly used a fake Zimbabwe Republic Police General Headquarters dispatch office, soiling the force’s reputation in fight for a car, has been taken to court.
Tapiwa Maswela, 39, appeared at the Harare Magistrates’ Courts charged with fraud.
He was granted US$100 bail.
The complainant in this matter is the ZRP represented by Rangarirai Nyanhamo, 40.
The State alleges that in February 2021, Nyamande filed a criminal case against one Bernard Guveya of unlawful borrowing of a motor vehicle at Hatfield Police Station.
The matter was later referred to Harare Magistrates’ Courts where Guveya was found not guilty and was acquitted, causing the police to release the car which was kept as an exhibit to Guveya.
The State alleges that on June 2022, Maswela claimed ownership rights to the car that had been released to Guveya.
It is alleged that he used a forged ZRP General Headquarters dispatch office date stamp in stamping a court application, claiming he had served the Commissioner General of Police, whom he cited as the first respondent.
He allegedly inscribed the name of one Constable Mupakaviri as the recipient of the court application.
The court heard that Maswela then submitted a certificate of service to the High Court, claiming to have served the Commissioner General of Police.
It is alleged that on July 6, 2022, Justice Webster Nicholas Chinamora of the High Court passed verdict in default of the Commissioner General in favour of Maswela.
Justice Chinamora made an order that the Commissioner General release a Mercedes Benz E280 to Maswela.
The matter was unearthed on July 7, 2022, when the Commissioner General received an order which prompted an inquiry on how the determination was passed in default.
It was established that Maswela never served the police as there were no entries in relevant books to support his visit at the Police General Headquarters.
