A 17-year-old girl narrowly escaped prison when the magistrate fully suspended the one year jail sentence after convicting her of incest.
The teen and her 30 year olld nephew appeared before the Mutare Magistrate court facing charges of committing sexual intercourse within the prohibited degrees of the relationship as defined in Section 75(2)(f) of the Criminal Law (Codification and Reform) Act Chapter 9:23.
The state alleged that on an unknown date in January 2024, the man returned home and found his 17-year-old aunt in the kitchen.
He offered her US$1 if she would have sex with him.
Both accused persons agreed to keep the affair a secret and engaged in consensual sexual intercourse twice that evening, while the rest of the family were inside the main house which is separated from the kitchen hut.
The issue came to light when the 17-year-old discovered that she was pregnant and revealed that her nephew was the father.
The pair was sentenced to 12 months imprisonment.
However, 6 months were suspended for 5 years and further 6 months were suspended on the condition that the accused individuals will complete 210 hours of community service.
