A Glen Lorne man, Marshall Shadaya, 48, has appeared in court on fraud charges after allegedly selling a three-bedroom house in Strathaven, Avondale to two different buyers.
Shadaya is accused of defrauding Gift Zimbudzana, the complainant in the case, by entering into a fraudulent sale agreement. The incident occurred on March 23, 2024, when Shadaya agreed to sell the property, which measures 928 square meters, to Zimbudzana for US$120,000. Zimbudzana paid a deposit of US$80,000 upon signing the agreement, with the remaining US$40,000 to be paid in installments over six months.
However, Shadaya allegedly failed to disclose that the property was already under a mortgage bond.
The fraudulent nature of the transaction was discovered on September 12, when Zimbudzana learned that Shadaya had entered into another agreement with Cecil Kachambwa, selling him the same property.
Zimbudzana reported the matter to the Avondale Police Station, leading to Shadaya's arrest on October 14.
Investigations revealed that the house in question is owned by Rousham Computers Private Limited and is under a mortgage secured by a loan Shadaya took in 2010.
He had borrowed US$24,000 from Brian Mafirambudzi, using the property’s title deed as collateral, but had failed to repay the loan. As a result, the title deed remains with Mafirambudzi’s lawyers.
Shadaya was brought before the Harare Magistrates' Courts and was granted bail upon payment of US$200.
Zimbudzana suffered a financial loss of US$80,000 due to the fraudulent sale.
