Seed Co Limited has successfully sued a soya bean farmer, Christian Falkenberg, to recover US$274,768. The seed company had financed Falkenberg's farming production but faced challenges when he sold the product to another company.
Falkenberg had raised a special plea against Seed Co's claim, arguing for arbitration. However, the High Court judge, Justice Joseph Chilimbe, ruled in favor of Seed Co, stating that the arbitration agreement did not supersede the clear breach of contract by Falkenberg.
The court found that Falkenberg had diverted 132 metric tonnes of certified seed, violating the terms of the production contract with Seed Co. This breach of contract resulted in significant financial losses for Seed Co.
