Eastwind Trust's development of 395 residential and commercial stands at Donnybrook Farm in Tafara-Mabvuku is set for regularisation by the Harare City Council (HCC), putting an end to speculation surrounding the project's legitimacy. This development comes after a High Court ruling in favor of Eastwind Trust against Homegram, a company linked to former Mt Pleasant MP, Jason Passade, which had also claimed ownership of the land.
The HCC, in a letter dated December 19, 2023, addressed to the ZRP Ruwa, confirmed Eastwind Trust's status as one of 16 land developers in the Tafara-Mabvuku area whose operations are under consideration for regularisation. The letter, signed by HCC Housing and Community Services Director, Addmore Nhekairo, acknowledges the ongoing regularisation process and explicitly states that the council will be guided by the High Court order (HC6331/23) that affirmed Eastwind Trust's claim to the land.
"Please be advised that the land in dispute is council land," Nhekairo wrote. "However, council has received a request by Eastwind Trust for regularisation and their request is still under consideration. Further take note that we have taken note of the High Court order HC6331/23 granted in favour of Eastwind Trust. Council shall stand guided by the said High Court order."
This recognition by the HCC and the favorable court ruling provide a significant boost to Eastwind Trust's project, paving the way for the formalization of their development activities at Donnybrook Farm. The regularisation process will likely involve compliance with council planning regulations and other necessary procedures.
The resolution of the land dispute and the ongoing regularisation process offer clarity to residents and potential investors in the Tafara-Mabvuku area, promising a more structured and secure development environment.
