A Borrowdale woman who went into an agreement in which she was temporarily given a car for use ended up selling it. She has been taken to court for the deed.
Mikki Muringi now faces charges of theft of trust property as defined in Section 113(2)(d) of the Criminal Law Codification and Reform Act, Chapter 9:23.
She appeared before magistrate Evelyn Mashavakure who gave her a bail of ZWL$50 000 and ordered her to return to court on March 9 pending finalisation of investigations.
The facts of the case are that in May 2022, Muringi was given a Mercedes Benz E200 by Lloyd Mugezi. This was under a trust agreement which required Muringi to later return the car to Mugezi, which she failed to do.
When she was arrested, Muringi appeared to have sold the car as she had US$4 500 which she shared with her accomplice who is also on remand.
The court heard that upon arrest, she tried to negotiate the reimbursement of the money.
Meanwhile, a Westley man who is facing two counts of unlawful entry and stealing property from two houses has been arraigned before the courts.
Richard Hodzi, 48, is being charged with unlawful entry.
Magistrate Evelyn Mashavakure rolled his matter to Wednesday for bail application.
The circumstances of the case are that on January 3, 2022, at around 0100hours at number 72 Poers Road in Borrowdale, Harare, Hodzi intentionally and without permission from Paul Bowen who lives at the premises forcibly entered the latter’s house.
He opened the dining room to gain entry and stole a 42-inch Sharp television set, an Apple laptop and 9000 Mozambican Meticais.
On February 2022, in a separate incident, Hodzi and his accomplice who is still at large went to lan Harris’ residence and entered the house with the intention of stealing.
They stole 42 different fishing rods, reels, 275 packets of soft plastic bait, 1 × 12 volts car battery, maglite, tent bag, black back pack with assorted gary yama moto, big bite, zoom plastic bait and red bag with assorted fishing tackles.
