Court Challenge on Bill No. 3 Withdrawn, Set to Return With 241 Witnesses

A legal challenge against Constitutional Amendment No. 3 has been withdrawn, but only to return in a potentially much bigger form, with 241 witnesses expected to be cited for oral testimony.

Former Mkoba South MP Amos Chibaya and ex-student leader Allan Chipoyi withdrew their urgent High Court application after Judge President Mary Zimba-Dube ruled the matter raised disputed facts too extensive to be settled on paper alone.

The pair will now refile, seeking a full hearing on claims that public consultations on the Bill were marred by violence, intimidation and exclusion in five cities, undermining the legitimacy of the process. Their fresh application is expected to lean on testimony from witnesses alleging opposition voices were blocked or assaulted during hearings.

The move keeps alive a legal challenge to a Bill that includes proposals linked to the 2030 agenda, including extending President Emmerson Mnangagwa’s term from 2028 to 2030.
