Charles ‘Boss Torro’ Guvamatanga pleads not guilty

Charles Guvamatanga, popularly known as Boss Torro in social circles, has tendered a plea of not guilty to the allegations of rape, which he describes as a fabrication and a counter to his report, adding that he is the one who was violated by the teenager who seemed “possessed” while demanding to be intimate with him.

Guvamatanga’s lawyers questioned how a 17-year-old virgin would be raped in a house with other people and not raise alarm or rush to notify her sisters in a room five metres away from the alleged crime scene.

They described the allegations as an unbelievable creation aimed at tarnishing Guvamatanga’s image.

This came after the girl told the court that she was a virgin when the alleged sexual act occurred and never screamed or made noise during the act which lasted approximately 15 minutes.

It is the defence’s argument that no virgin girl could be deflowered and remain silent, especially under rape circumstances and then not tell the police that she had lost her virginity.

Responding to the questions, the girl said she was afraid of Torro and could not even move.

The lawyers argued that any lady losing her virginity even in consensual circumstances would feel pain and bound to react and making noise.

They said the situation would have been worse, especially in rape or violent circumstances.

This, they say, mean the girl was not a virgin as alleged and that the act never happened as she alleged.

In his defence outline, Torro makes it an issue, describing the claims as false and unbelievable.

“Why would she not scream when she allegedly saw that accused was about to rape her or even during the alleged rape or soon after since she knew her sisters were in the lounge just about 6m away,” the lawyers submitted.

Torro says the girl made the allegations as a counter report and out of embarrassment after he declined her advances.

His lawyer Dumisani Mthombeni said it is embarrassing for any lady to have her advances, naked, declined by a man which he said is behind the allegations after Torro threatened to report her.

“These are poorly choreographed rape allegations by someone desperate to save face and embarrassed,” his lawyers submitted.

Torro maintained his story that he is the actual victim having been drugged and only waking up finding the girl naked in his bedroom.

The girl also told the court Torro was wearing a white t-shirt and black shorts which he disputed before producing video evidence showing him in an Arsenal jersey, casting doubt on the girl’s testimony.

Questioned on the issue of the jersey, the girl said she could not recall what Torro was wearing despite spending over five hours together clubbing.

“Accused never raped complainant in the manner alleged or at all. In fact, he is the actual victim in this case because complainant committed an act of aggravated indecent assault upon him while he was in an involuntarily induced sleep and inebriation.

“He was shocked to see complainant in his bed sitting on top of him holding his penis with her right hand and trying to force his penis into her vagina,” his lawyer submitted.

It is also their argument that the accusers testimony is full of inconsistencies stating that what she told the police, her sisters, her nurse and the court was contradicting.

They pointed out that when she was giving her testimony, she stated that she called her sister and told her about the act on the phone but before the court she stated that she called her sister and narrated her alleged ordeal in person.

They also raised doubt over her testimony that she had a blood-stained panties which she noticed five hours after the act when she went to the clinic.

The trial will continue tomorrow.
