Opposition Citizens Coalition for Change has appealed against a High Court judgement banning recalled MPs from contesting in the Saturday by-elections.

This comes after High Court judge, Justice Never Katiyo ruled in favour of self-styled CCC secretary-general, Sengezo Tshabangu’s application to have recalled party lawmakers banned from contesting in the upcoming plebiscite.

The Zimbabwe Electoral Commission had since issued a statement endorsing the High Court decision.

CCC deputy spokesperson, Gift Ostallos Siziba said they have since served ZEC with the appeal papers.

“We have just been to ZEC and have served the Chief Elections Officer, (Utoile) Silaigwana with our Supreme Court Appeal accompanied by a letter demanding the assurance that our candidates are on the ballot for tomorrow,” Siziba said.

Read part of the appeal: “We refer to the above matter in which orders were granted by the High Court (per Katiyo J) in Case No, HCH 7543/23.

“We write to advise that our clients, Prince Dubeko Sibanda and 23 others, have appealed the High Court judgement/orders in this matter. Case No. SC 679/23 refers. We attach hereto a copy of the notice of appeal duly issued by the Supreme Court.

“In the High Court, the 1 and 2 Respondents were seeking declaratory orders, consequential relief and interdicts.”
