South Africa wins ICJ case against Israel

South Africa has won its case against Israel on the indication of provisional measures at the International Court of Justice.

This comes as the ICJ had heard both oral arguments on the case from South Africa and Israel, to which it granted the order for provisional measures.

In its judgement, the ICJ ordered Israel to take all measures to prevent acts of genocide and free flow of humanitarian aid into Gaza.

“That Israel shall submit a report on all measures taken to give effect to the ICJ order within one month. That Israel shall take immediate and effective measures to allow basic services and humanitarian assistance to Gaza,” ICJ ordered.

South African President, Cyril Ramaphosa while celebrating the milestone added that his country took the step against Israel informed by its own struggles and fight against apartheid.

“As a nation that fought and defeated apartheid, we have a particular obligation to stand up for justice and fundamental human rights for all people everywhere,” Ramaphosa said.

Legal analyst, Professor Thuli Mandonsela also commended after the judgement insisting that the court said he’s to all counts and that of the risk of irreparable harm should Israel continue against the order on provisional measures.

“In simple language, the ICJ has said there is prima facie violation of the Genocide Convention specifically articles II (a)-(d),” Mandonsela said.

Constitutional law lecturer, Fadzai Mahere also applauded the order by the ICJ and commended South Africa on the filing of the application indicating provisional measures.

“South Africa has won the provisional measures case against Israel at the ICJ at The Hague. In many ways, this is a historical moment for international law and for the conflict in Gaza,” Mahere said.
