Miccokays faces court for US$120k theft

Miccokays Enterprises Private Limited is facing charges of theft of trust property amounting to US$120,000.

The company, represented by Gamuchirai Machakaire, 46, appeared before the Harare Magistrates' Court to answer these allegations.

The complainant in the case, Zakir H Motola Investments Private Limited, is represented by one of its directors, Ibrahim Kabwe Mwamba. The company, which specializes in exporting goods such as biscuits and cornflakes from Zambia to Zimbabwe, had entrusted Miccokays Enterprises with the sale of these products.

According to the prosecution, led by Tawanda Nyandoro, the events began in May when Miccokays Enterprises, through Machakaire, approached Motola Investments claiming they had a network of clients eager to purchase their products. 

As a result, on July 24, Motola Investments handed over two truckloads of biscuits and one truckload of cornflakes to Miccokays Enterprises, with the goods valued at US$120,000.

Miccokays Enterprises assured Motola Investments that payment would be made once the goods were delivered to the clients. However, despite successfully selling the goods, Miccokays Enterprises failed to remit any of the proceeds to Motola Investments as agreed.

To cover up the failure to pay, Marko Gaka, acting on behalf of Miccokays Enterprises, allegedly sent a fraudulent proof of payment to Motola Investments. This prompted Motola Investments to file a police report after realizing the deceit. As a result, the company suffered a financial loss of US$120,000, with no recovery of the funds to date.

Miccokays Enterprises is scheduled to return to court on November 12, 2024, for further proceedings.
