A senior partner at Mukweva Law Chambers, Emmanuel Mukweva, 48, has appeared before the Harare Magistrates' Courts on charges of fraud and theft of trust property. The case was brought forward by Pacifio Trading Private Limited, the complainant.
The allegations date back to January 2023 when Mukweva, in collaboration with Ernest Chagadama of Oracle Estate Private Limited—who is currently at large—allegedly planned to defraud unsuspecting victims. The duo is accused of fabricating fraudulent documents to suggest that Lot 1 Of 636A of Greendale Township, Harare, was owned by Oracle Estate Private Limited.
The court heard that the property was advertised online for US$180,000. Pacifio Trading Private Limited, seeking land to construct a service station, expressed interest in the property. After initial discussions with Chagadama, the complainant was referred to Mukweva, presented as the estate’s legal practitioner.
A representative from Pacifio Trading Private Limited inspected the land and agreed to purchase it. Mukweva allegedly drafted the sale agreement, with the complainant agreeing to pay the full amount under specific terms: US$90,000 was to be advanced to the seller, while the remaining US$90,000 would be held in Mukweva’s trust account and released only upon the successful conclusion of the transaction.
Pacifio Trading Private Limited reportedly paid the full US$180,000 and was given a copy of the agreement. However, five months later, when no progress was evident, the complainant followed up with Mukweva. It was then discovered that the land was government property and not owned by Oracle Estate Private Limited.
Despite demands, Mukweva allegedly returned only US$20,000, evading further repayments and prompting the complainant to file a police report. Investigations revealed that the land had been reserved for the Government of Zimbabwe, and Mukweva had used falsified documents to mislead the complainant.
As a result of Mukweva's actions, Pacifio Trading Private Limited lost US$160,000. Mukweva has been ordered to appear in court on January 21, 2025.
