Malawi Court Approves Bushiri Extradition

The South African government has welcomed the ruling by Malawi’s Chief Resident Magistrate Court in the extradition case of Shepherd Bushiri and his wife, Mary.

The couple, who fled South Africa in 2020 under unclear circumstances while out on bail, are wanted on multiple charges, including rape, violating bail conditions, and financial crimes under the Financial Advisory and Intermediary Services Act, the Banking Act, the Civil Aviation Act, and the Immigration Act.

In a statement issued Wednesday, the South African Ministry of Justice and Constitutional Development hailed the ruling as a victory for judicial independence and international legal cooperation.

“This decision reaffirms judicial independence, international cooperation, and public trust in the legal institutions of both South Africa and Malawi,” said Ministerial Spokesperson Terrence Manase.

He emphasized that the ruling underscores the principle that no one is above the law, reinforcing accountability and transparency in both nations.

“Today’s ruling is a significant milestone in international legal cooperation, demonstrating the strength of both countries' judicial frameworks and diplomatic engagements,” Manase added.

According to the Justice Ministry, the extradition process underscores the crucial role of legal agreements and treaties in tackling transnational crime and ensuring fugitives face justice.

South Africa’s Department of Justice and Constitutional Development has been working closely with Malawi’s Central Authority, INTERPOL, the National Prosecuting Authority, and the South African Police Service to facilitate the extradition process.

While the Bushiris have indicated their intention to appeal the ruling, Manase confirmed that the South African government would oppose the appeal.

“We will await the outcome of the appeal process should they proceed. If they choose not to, we will await formal notification from Malawi’s Central Authority and make the necessary arrangements for their return,” he said.
