A Seke man who assaulted another man with empty bottles and sticks to death for proposing love to his girlfriend's minor child has appeared in court.
Obvious Mutake, 31, of Mhonda Village, Seke, appeared at the Harare Magistrates' Courts charged with murder as defined in Section 47 of the Criminal Law Codification and Reform Act, Chapter 9:23.
The state alleges that in December 2022, the now deceased proposed love to a 15-year old minor from Mayambara Village, Chief Seke, Chitungwiza. The minor is a daughter to the now deceased's 30-year old girlfriend.
The minor informed Mutake whom she stayed with about the love proposal.
On January 1, 2023, Mutake ordered the minor to lure the now deceased pretending as if she had accepted the proposal and she did as she was ordered to do.
She lured him to where she lived and upon entering the house, the now deceased took off his clothes but before he could execute his mission, he was confronted by Mutake and his accomplice identified as Tashinga Mahungu and the two assaulted him with booted feet, empty bottles and sticks.
They accused the now deceased of sleeping with mother and child at the same time and for that vowed to teach him a lesson.
He was assaulted for close to two hours until he was unable to walk.
After beating him up, they carried and dumped him at Mhonda Village cemetery, this after having taken his Huawei cell phone, one khaki pair of trousers, one pair of jean trousers and one purple jacket.
On the same day at around 1100 hours, the now deceased was found lying in pain with bruises all over his body and was taken to Chitungwiza Central Hospital where he was treated and discharged.
On January 10 at around 2000 hours, the now deceased's condition deteriorated and he was taken back to Chitungwiza Central Hospital by his wife Susan Mapanda.
He passed on after having succumbed to the injuries he sustained due to the assault by Mutake and his accomplice.
Mutake appeared before magistrate Dennis Mangosi who ordered him to return to court on February 6 pending finalisation of investigations.
He was advised to approach the High Court for bail because of the nature of his crime.
