A 70-year-old man who was a caretaker in Bulawayo’s Montgomery plots was sentenced to 13 years imprisonment by regional magistrate Dambudzo Malunga for sexually assaulting a 10-year-old girl.
The magistrate slapped him with a 15- year jail sentence after she found overwhelming evidence that he committed the offence.
The depraved man, who was staying at the same plot with the girl’s mother, pleaded not guilty but was convicted and sentenced after a full trial.
The man will, however, spend 13 years behind bars after two years of the sentence were suspended for five years on condition of good behaviour.
The magistrate said the accused was heartless as he disregarded that he was old enough to be the grandfather of the minor girl.
She also said he had a moral duty to protect the minor who considered him her grandfather as they had been staying at the same farm for a couple of years
The magistrate further highlighted that the man grew very close with the mother of the victim to the extent that they were like relatives but the elderly man disregarded all that.
The court heard that sometime in May this year but on a date not known by the prosecutor the accused called the minor girl to where he was sitting and the unsuspecting girl went to him.
Upon reaching him the man asked her to sit on his lap before he touched her private parts.
It was heard in court that he lifted the minor to his bedroom where he carried out the sexual attack.
After sexually attacking her, the man threatened to kill her if ever she disclosed the ordeal to anyone.
However, the minor gathered courage and told her mother who reported the incident to the police leading to the arrest of the elderly man.
