Shawashagri Private Limited has been taken to court accused of defrauding another firm, Sandton Textiles Private Limited.

Shawashagri Private Limited represented its director, Lillian Nyamasoka, who is also being charged with Criminal Procedure and Evidence Act, appeared before magistrate Munashe Chibanda.

They were ordered to deposit US$500 bail and will appear in court on November 17 for routine remand.

The complainant in this matter is Sandton Textiles Private Limited.

The State alleges that on May 17, Sandton Textiles Private Limited was contacted by Nyamasoka who said she had 100 tonnes of cotton lint in Checheche, Chipinge, which she was selling.

On that same date, Sandton Textiles Private Limited arranged and someone went to Chipinge and was directed to Agricultural Value Chain/Parrogate Checheche by Nyamasoka where he inspected the cotton lint and became interested.

Sandton Textiles Private Limited agreed with Nyamasoka to buy 60 tonnes at US1.45 per kilogramme to make it US$87 000 total buying price.

They allegedly verbally agreed that Sandton was going to pay first before collection and the lint was going to be delivered within the first two days from the date of payment with Sandton providing the transport.

On May 24, Sandton representative, Omega Mugwagwa - together with Kudakwashe Yassin Kutyauripo - went to Nyamasoka’s workplace where they also met Tonderai Njenda and Sarudzai Njenda, who are still at large and had a written agreement, Tonderai representing the seller.

On the same day, Sandton deposited US$30 000 and was given a receipt.

On May 29, and 31, Kutyauripo went to the accused persons’ workplace where she paid US$13 500 and US$40 000 respectively and was given receipts.

On June 2, a Sandton truck driver went to Checheche, Chipinge to collect the lint but failed to collect as there was no release instructions from Ecobank Zimbabwe authorising the release.

Sandton allegedly made efforts for the accused to deliver the cotton but to no avail, leading to them making a police report.
