Former director of Nobtas Private Limited has been arraigned before the court after it was discovered that he had left unresolved matters he had conducted without the knowledge of the company, leading to the company suffering a loss of over US$7 000.
Nolbert Ruhukwa, 28, of Westgate appeared before magistrate Dennis Mangosi at the Harare Magistrates’ Courts charged with fraud.
The complainant in the matter is Raymore Machingura, 37, Director of Nobtas Private Limited.
The State, through Zororai Nkomo, alleges that in 2021, Machingura and Ruhukwa registered a company, Nobtas Private Limited, which deals with radiators, radiator spares and Nissan Caravan spare parts.
Machingura was a non-executive director as well as company manager.
On October 19, 2021, Ruhukwa used a company receipt book in selling an outside company car, a Nissan Caravan ZD30 engine for US$2 700 to one Innocent Chiposiwa, who later made civil claims for a defective component sold to him by Ruhukwa.
On February 4, 2023, Ruhukwa resigned from the directorship of the company, leaving the claims unresolved yet he was the one who had made the transaction outside the knowledge of the company.
On February 16, an order was granted by the High Court for Machingura to pay civil suit with costs to the tune of US$7 193.57.
Machingura made reconciliation of records and discovered that Ruhukwa had used company documents in form of receipts and sold property which did not belong to the company.
He further discovered that Rukuhwa had been attending civil court proceedings without notifying the company.
Rukuhwa’s actions caused the company to suffer a prejudice in the sum of US$7 193.57 as a result of a law suit directed to the company.
Mangosi gave Rukuhwa ZWL$100 000 as bail and ordered him to come back to court on June 6.
