Court dismisses woman’s application for a court order

An estranged wife has taken her husband to court, claiming that he was chasing her out of their matrimonial home saying she was mentally challenged.

Martha Kandera pleaded for a peace order before magistrate Tamara Chibindi at the Harare Civil Court against Brian Mureya.

“He is my husband, the problem started in 2021 your Honour. He started saying l should pack and move out of the house as l was mentally challenged.

“He threw my things away,” she said.

Kandera told the court that she was not given a chance to even see her children and her husband wanted to kill her.

She added that when she wanted to approach the courts against him, he told her that he was connected with the party and courts were powerless before him.

“He threatened me that the court does not have any power in this area.

“He threatens to kill me,” she said.

Kandera added that Mureya was in the habit of selling her stuff that enabled her to make a living.

“When we were together, he would sell things l use for recycling to make money, he also took all of my property,” she said.

Mureya denied Kandera’s allegations, he said she was the one who was in the habit of running away from their matrimonial home.

“I oppose what she is saying. She has left the home three times.

“She can even go for a year without appearing at home,” he said.

Mureya added that he was once told that she was now in Kwekwe and that is where she was now living.

She said he was even surprised when he was summoned to court.

“I was worried about her because she was not at home. I was surprised when she gave the papers,” he said.

Chibindi dismissed the peace order application by Kandera. She said there were chances of her using the peace order to get her way into the house thereby abusing it.
