A man who feels that his older brother is not yet done babysitting him as he wants to assault him in front of his wife and child claiming that he was having an affair with his wife has appeared in court.
Isheanesu Kuzamba appeared before magistrate Tamara Chibindi at the Harare Civil Court pleading for a protection order against his older brother, Anesu Kuzamba.
He alleged his brother was in the habit of assaulting him and there was no respect between the two. This, he said, started when their mother had come to court after having a misunderstanding with him and took a peace order against him in the process.
"He started to vent that anger on me. He threatened he would assault me, my wife and my child.
"He then fulfilled what he said when he came to my place of residence on another day. Before his arrival, l ordered my wife to vacate the premises with the child.
"He assaulted me and after that, he told me that he was not yet done with me as he wanted to deal with me in front of my wife.
"He did this claiming that l was sleeping with his wife when he was in South Africa," he said.
Anesu denied the allegations that his young brother laid against him, saying the problem started when he broke their mother's phone.
"There was a time when l was on the phone with mother and he was at home with her in another room. He came from the room where he was saying he had heard his name during my conversation with her and he took the phone from her and broke it.
"Traditionally, that is a serious offence and l arranged that l must find a way of compensating the phone he broke and l called my uncle for us to go together to her place.
"When we got there he was in the house and we ordered him to go outside as we were getting ready for a conversation. In the middle of the conversation he came claiming that he had heard his name and causing all sorts of problems," he said.
Anesu told the court that he started to insult him which later angered their mother.
He also denied allegations by his brother that he had assaulted him because he had an affair with his wife.
"He said he was not my blood brother and that statement angered mama who ordered him to withdraw the statement but he refused.
"About him having an affair with my wife l do not know anything about it, even my wife said she did not know anything about the affair.," he said.
Chibindi dismissed the protection order by Isheanesu claiming that it lacked merit.
