Former Housing Official in Dock Over US$60K Land Scam

A former official of a housing consortium has appeared in court accused of swindling the company out of US$60 000 by fraudulently selling a stand without authorisation, while also allegedly prejudicing the government in a separate land deal.

Harry Muzondo, of Southlea Park, Harare, was detained and is awaiting a bail ruling scheduled for today.

Sensene Investments (Pvt) Ltd, the complainant in the case, was represented by its Chief Operating Officer, Marshall Jonga.

According to prosecutor Rufaro Chonzi, the Ministry of Local Government issued a Deed of Transfer to Sensene Investments on July 8, 2015, for a parcel of land at Odar Farm, Harare, as part of the government’s urban expansion programme.

 The company was mandated to act as custodian and intermediary, collecting compensation payments from occupants and issuing title deeds to formalise ownership.

Court papers allege that on July 19, 2017, Muzondo fraudulently sold Stand 7650 in Odar Farm to Livingstone Garikayi without the company’s knowledge or consent, despite knowing he lacked lawful authority. 

Garikayi, acting in good faith, paid US$60 000 for the stand, believing the transaction to be legitimate. 

He suffered financial prejudice when he lost both the money and the anticipated property rights.

The State further alleges that on December 4, 2012, Muzondo fraudulently sold Stand 6994, measuring 2 000 square meters in the remainder of Odar Farm, Southlea Park, to Rudo Christine Gorimani. 

At the time, the land was state-owned, having been compulsorily acquired by the government in 2010, rendering the sale null and void.

The misrepresentation allegedly prejudiced both private buyers and the government, with losses running into thousands of dollars.
