Murehwa Man Accused of Pocketing Rentals From Deceased Relative’s Estate

 

 

A 67-year-old man from Murehwa has appeared in court facing allegations of unlawfully collecting and using rental income from properties belonging to a deceased relative’s estate.

Kudakwashe Jani, who resides at house number 228, corner Robert Mugabe and First Street in Murehwa, is accused of misappropriating rental proceeds from properties registered under the estate of the late Emias Shayehama Jani.

According to court papers, Emias Shayehama Jani, who died in 1997, left behind several properties, including two shops at Murewa Town Centre, a house in Lusaka, Highfields, and a plot in Rukodzi under the Musami area.

Before his death, the late Jani reportedly expressed his wish that his estate benefit his children and grandchildren. The estate was subsequently registered with the Master of the High Court in 1999 under reference number DR3121/99, with a will directing that all rental proceeds be deposited into the Guardian’s Fund pending proper distribution.

Over the years, several executors were appointed to administer the estate. These included the late Walter Pahla of Worldwide Executor Trust (Pvt) Ltd, Zacharia Mateta of Pretty Executors and Trust Company (Pvt) Ltd, and John Fadzisayi Jani, whose appointment was later nullified by the High Court under order HC4075/2020.

Despite never being appointed as an executor, Kudakwashe Jani is alleged to have collected rentals from the estate’s properties between 2018 and December 2025, using the funds for personal benefit in contravention of legal directives.

The complainant in the matter is the State, represented by the Master of the High Court, while the case was brought to light by Thario Tanatswa Jani, 20.

The total amount allegedly misappropriated has not yet been established, and nothing has been recovered to date.

Jani is expected to return to court on February 2, 2026.
