Man takes advantage of buyer's death, resells same property to another

An Epworth man has appeared in court for fraud after selling an estate to a buyer, not changjng the title deeds and later selling it to another person following the initial buyer's death.

Thomas Gobo Munemo, 76, of Epworth was before magistrate Dennis Mangosi at the Harare Magistrates' Court charged with fraud.

The complainant in the matter is Munashe Nyazuwa, 24, of Hatcliff who is the son of the late Batsirai Nyazuwa.

The State, through Zebediah Bofu, alleges that on December, 14, 2006, Munemo sold Lot 1 of Lot 310 Block B, Hatfield Estate, to Munashe's father, the late Batsirayi Nyazuwa for ZWL$35 000 000 and they both entered into a written agreement of sale.

Munemo did not change ownership of the property until the death of Batsirai and his wife in 2020.

Munemo then took advantage of Batsirayi and his wife's death and sold the same property to one Masimba Kwindima.

Munemo effected deed of transfer to Kwindima who then caused the eviction of Munashe from the property.

That led you Munashe's father suffering a prejudice of ZWL$35 000 000 and nothing was recovered.

Mangosi ordered Munemo to pay ZWL$35 000 000 bail to the clerk of court. He was instructed to continue residing at the given address until the matter is finalised.

He will appear in court on June 13, 2023, pending finalisation of investigations.
