Harare magistrate, Donald Ndirowei, has refused to remand Harare Youth League Chairman, Emmanuel Mahachi, who was arrested on armed robbery charges.
Mahachi, 36, of Westgate, appeared before magistrate Ndirowei on allegations of armed robbery.
Ndirowei cited that the matter had more do to with land issues than the matters at hand.
The State, through prosecutor Anesu Chirenje, alleges that on January 24, 2024, at around 1730 hours, the complainant, Bright Nyausopo, who is employed by Blessed Charakupa as a private security guard at Vito Complex, Mbare, Harare commenced duty at around 1700 hours.
At around 2030 hours, Mahachi allegedly came driving a black twin cab vehicle without number plates escorted by another white twin cab which had no number plates as well.
He then came out from his car holding a CZ pistol serial number 20760 and ordered the complainant and his colleagues, who had been tasked by the owner of the property, Charakupa, to do maintenance at the complex, to vacate.
The complainant confronted Mahachi, but he allegedly threatened to kill him, pointed the pistol towards the complainant and fired two shots in the air.
The State alleges that fearing for their lives the complainant and the welders fled from the scene, leaving the welding machine and the generator at the gate.
Mahachi allegedly loaded the welding machine and the generator in his car and fled the scene.
The complainant filed a police report at ZRP Mbare.
