The trial of the former Vice President, Phelekezela Mphoko will carry on following the dismissal of his application for review which he filed, contesting the refusal by a Bulawayo magistrate to discharge him at the close of the State’s case, the National Prosecuting Authority said in a statement.
It is noted that on July 13, 2016, Mphoko who was then the sitting Vice President of Zimbabwe and hence a public officer, allegedly intentionally appeared at Avondale Police Station and unlawfully ordered the release of Moses Julius Juma and Davison Norupiri from police custody.
It is alleged that in doing so, the accused person abused his office.
The High Court, sitting in Bulawayo, dismissed the application for review and held that the State had managed to establish a prima facie case against the accused person.
“Proceedings at the Magistrates’ Court are expected to continue in due course,” the NPA said.
Mphoko is being charged with criminal abuse of office for allegedly ordering the release of then Zimbabwe National Roads Administration acting chief executive Moses Juma and board member Davison Norupiri from Avondale Police Station in Harare following their arrest in 2016 for fraud and criminal abuse of office.
The two were arrested and detained at Avondale Police Station pending a court appearance on July 14, 2016.
It is alleged that, on the same day at around 6pm, Mphoko, allegedly stormed the police station and ordered the immediate release of the pair.
