Can someone please stop the loose cannon called Marriot?

The Dynamos family last week woke up to some interesting lies from Bernard Marriot about Dynamos football club on the occasion of the launch of the novel 60th anniversary of the fabled club.

Marriot, unashamedly tried to rewrite the history of the club and was so excited that he called his selected band of media to lie to about a club, whose history can not be changed because it is nakedly historic.

It can not be wished away that Dynamos was formed in 1963 at the Tobacco Sales floors in Harare by players who were formerly  Salisbury United or City. Marriot, even if he tries to invoke the bible and state that he is Seventh Day Adventist, he was not present at formation and therefore not a founder of the club.

What is sad is that Marriot knows he is lying and he is not a founder member. It does not matter much because is his lying, as often liars do, they forget they have to have a photo memory, which Marriot does not have.

In trying to convince his hired audience, he mixes issues and dates. He tells his audience the club was formed in 1962 and then renamed Dynamos in 1963. He could not have known the true story because he was not part of it.

To further prove his lying Marriot went to tell the audience that he played with Webster Marechera at onset of the club. This Marechera was only 13 years in 1965, three years after the formation of the club.

In fact Marechera, with other youngsters like Laban Kandi played in the junior team in the late 60s into the early 70s before, Marechera joined the liberation struggle in 1975 in Mozambique and returned at independence. So, where did Marriot play with him?

For those in the know in Rhodesia, the legal age of majority was 21 and no one under that age was allowed association. How old was Marriot in 1963 (never mind his age today) and Marechera the same year for them to have been team mates?

Marriot was lying to take a dig at Ernest Kamba, a multiple soccer star of the year at the club who was brought to the club by the legendary Obediah Sarupinda and Fanuel Dube. Where was Marriot at the time? How many matches did he play?

Marriot should just desist from lying to take control of a club that belongs to its members. That its members are asleep is not a licence for him to steal more. This Dynamos matter is simple. Marriot is a fraud. The club is not company owned as he is trying hard to profess.

For him to say the 1963 Dynamos constitution was repealed in 2008 is just a high joke that can only be told to a hired audience as the one that was gathered.

The Justice Luke Malaba supreme court ruling is very clear that the club belonged to its members, who are described as founder players, to which there is none living at the moment and former players, which include the rest of them.

The Malaba judgement say that only electoral college, which is the exclusive club of founding and former players, to which we now only have former players, is the ultimate authority that elects a board of trustees which in turn appoints an executive committee to run the day to day affairs of the club.

This precludes any proviso for one man (Marriot) to claim to be a board in which he willy-nilly appoints and disappoints at the turn of political intentions, as he did with Isaiah Mupfurutsa recently.

Mupfurutsa and crew had ceased to save his interests after Marriot discovered, the banker was in league with the G5 renegades fronted by Moses Chunga. Marriot had also discovered that Sakunda was still interested in the club after exposes by The Page had put skids to the hostile takeover.

Now Marriot is hoping to cash in alone, but was told by Sakunda to prove beyond any reasonable doubt that he owned the club, which he is trying to do by peddling and publishing this lie. A lie that can not stand even the blow of the wind.

The Marriot claim that the club is owned by the Dynamos Pvt Ltd is a lie and a misrepresentation fed on people who are either ignorant of the Malaba judgement of 2006 or simply choose to ignore the simple fact a company birthed out of the 1963 constitution, can claim to own the club that provided for the formation of the company.

How is it possible that Marriot claims the 1963 constitution was repealed, yet the same constitution is the one that provided for the existence of the company, he now claims, owns the club? An ironic egg and chicken poser. If he the 1963 constitution, where did the company come from? How did he repeal a constitution he did not author without the express agreement of the members?

Marriot interestingly chided the club that Dynamos formed in 1963 in Salisbury, in Rhodesia can not continue to be called thus and therefore its constitution was repealed in 2008 to reflect the independence. What piece of hogwash!

He now claims that he in 2008, with a group of his apologists and friends repealed the constitution and replaced it with the memorandum of articles of association.

Yet, it is clear in the constitution and emphasized by Malaba in his 2006 judgement that any amendment to the statutes should be done according to clause 15.1.3.

"If an amendment to the constitution was to be proposed at the AGM, a written notice of the meeting containing the terms of the resolution on the proposed amendment had to be given to all members forty days before the date of the meeting..."

A perusal of the register, Marriot claims was of the meeting has people who are not members of Dynamos and therefore not eligible to vote or amend the statutes to enable the change.

"Founder and former players are the only bona fide members of the club and they are the persons who have power and right to change or amend the club's constitution (the one Marriot claimed was used to change Dynamos into a company run club). Any other amendments made unless proposed by and approved by the electoral college, are null and void" (clause 15.1.1).

So, all this noise by Marriot is hollow. He can not meet with his friends and call that meeting an electoral college, with authority to make decisions and changes for the club.

It does not work like that. If it works like that at the Seventh Day Advent church, where he gathers his friends for a meal, it is different at a club like Dynamos.

Lies have very short legs and this club called Dynamos is in this state because its bona fide members are selfish and not united, a weakness that Marriot has exploited to cause this havoc.

The former players, the electoral college, board of trustees and the Dynamos executive have in their hands the Malaba judgement and order and it is a wonder they still hope to be attracted by promises of some shoddy monies from benefactors and sponsors, yet they are failing to effect the Malaba order.

Marriot can not be allowed to run the club roughshod and aim pot balls at former stars like Kamba and David George. Iye mudhara Marriot akambotamba rakanyanyodii rekuti anobva azviti ndiye Dynamos?
