Girlfriend to arrested former NetOne employee, Daniel Kalira has taken the Zimbabwe Anti-Corruption Commission to court over the confiscation of her four vehicles by the anti-graft body.
This comes as Zacc sized the vehicles as collateral following the arrest of Kalira, 39, last year on allegations of stealing ZW$150 million worth of airtime from NetOne.
Following the arrest, the anti-graft body seized Kalira's three Mercedes Benz vehicles and one Toyota Hilux, arguing they were purchased using proceeds of the crime.
In an attempt to recover the vehicles, which she claims are hers, Kalira's girlfriend, Charlotte Chavavarirwa, has filed an urgent chamber application with the High Court.
She argues that she needs the vehicles urgently because she uses them to ferry her children to school, adding that her business was on the verge of collapse because it's mode of transport had been seized.
Chavavarirwa also said she has now been reduced to a pedestrian following the seizure of the cars.
However, High Court Judge, Neville Wamambo dismissed her application, ruling that there was nothing harmful about being a pedestrian as Chavavarirwa could seek alternative transport for now.
“I find that applicant being rendered a pedestrian is not irredeemable harm,” said the judge.
“Damage to the said vehicles while in the custody of a government entity is improbable.
“I am mindful that there are rules, regulations and procedures aimed at preserving property lawfully seized.
“The same would apply to the issue of compensation in any case if so, advised nothing can stop applicant from suing the relevant government entity if damage is visited upon the vehicles…in the circumstances, I found no urgency to the matter,” ruled the judge.
Kalira, according to Zacc investigations, would steal from the mobile network operator through an airtime voucher scam committed over a period of two years.
Zacc was tipped of the scam following a sudden change in Kalira’s lifestyle, raising suspicions among those in his circles his surprise lavish lifestyle might have been a result of criminal activities.
Kalira now owned a fleet of vehicles that included a Toyota GD6 twin cab, three Mercedes Benz vehicles and two BMW sedans.
